# privacy policy

This Privacy Policy explains how **Precence** ("we", "us", "our") collects, uses, and protects information when you visit precence.com or book a diagnostic call. We aim to be transparent and concise. If anything is unclear, email marketing@precence.com.

## 1. Who we are

Precence is an AI consultancy based in Amsterdam, the Netherlands. We act as the data controller for personal data collected through our website. Contact: marketing@precence.com

## 2. Personal data we collect
### 2.1 When you contact us by email

We receive your email address, the content of your message, and any information you choose to include.

### 2.2 When you book a diagnostic call

Booking is handled by **Cal.com**, our scheduling provider. They collect your name, email, scheduled time, and any notes you submit. We receive a copy so we can attend the meeting and follow up. See Cal.com's privacy policy at cal.com/privacy for their full handling.

### 2.3 Technical information

Our hosting provider may automatically log standard server information (IP address, browser type, page accessed, timestamp) for security and operational purposes.

### 2.4 What we don't collect

We don't run advertising trackers, behavioural analytics, or cross-site tracking. We don't set cookies on this site beyond what's strictly necessary to make it work.

## 3. Legal basis for processing (GDPR)
-

**Contract performance** (Art. 6(1)(b) GDPR): when you contact us about an engagement or book a diagnostic call, we use your information to respond, schedule, and provide our services.

-

**Legitimate interest** (Art. 6(1)(f) GDPR): for security logs and basic operational purposes.

-

**Consent** (Art. 6(1)(a) GDPR): for any future marketing communications. We'll ask first; you can withdraw consent at any time.

## 4. Who we share your data with
-

**Cal.com**: our scheduling provider, processes booking data on our behalf as a data processor.

-

**Hosting and email providers**: we use third-party hosting and email infrastructure. They process data on our behalf under EU-standard data processing agreements.

-

**Professional advisors**: accountants, lawyers, etc., on a need-to-know basis if relevant to a paying engagement.

We do not sell your personal data. We do not share it for advertising purposes.

## 5. International data transfers

Some of our service providers (Cal.com, hosting) may transfer data outside the EU/EEA. When this happens, we rely on standard contractual clauses or other appropriate safeguards under Articles 44–49 GDPR.

## 6. How long we keep your data
-

Email correspondence and booking-related data: as long as the relationship is active, plus a reasonable follow-up period (up to 2 years after last contact).

-

Invoices and tax-relevant records: 7 years, as required by Dutch tax law.

-

Server logs: typically retained for up to 90 days for security purposes.

You can request deletion of your data at any time (see your rights below).

## 7. Your rights under GDPR

You have the right to:

-

**Access**: request a copy of personal data we hold about you

-

**Rectification**: correct inaccurate data

-

**Erasure**: ask us to delete your data ("right to be forgotten"), subject to legal exceptions (e.g., we must keep invoices for 7 years per Dutch tax law)

-

**Portability**: receive your data in a structured, commonly used format

-

**Restriction**: limit how we process your data

-

**Objection**: object to processing based on legitimate interest

To exercise any of these rights, email marketing@precence.com. We aim to respond within 30 days. If you believe we are not handling your data lawfully, you have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) at autoriteitpersoonsgegevens.nl.

## 8. Security

We take reasonable technical and organisational measures to protect personal data, including HTTPS encryption, access controls, and secure data processing agreements with our subprocessors. No system is perfectly secure, but we work to minimise risks.

## 9. Children

This website is not directed at children under 16. We do not knowingly collect data from children. If you believe a child has provided us with personal data, contact us and we will delete it.
